Action brought by Robert Williams in the Cass County District Court for a declaratory judgment declaring unconstitutional L. 1957, c. 730, establishing the Board of Education of the Unorganized Territory of Cass County, and to enjoin Gertrude Rolfe, superintendent of schools of said county, from proceeding with the consolidation of said unorganized territory with other school districts. The school boards of the unorganized territory and of Independent School District No. 115 were permitted to intervene. Plaintiff appealed (No. 38,350) from an order, John T. Galarneault, Judge, declaring the statute unconstitutional but refusing to invalidate acts already performed thereunder and certifying the questions presented to be important and doubtful. This appeal was consolidated with an appeal (No. 38,351) by Russell Lego, Robert Williams, and Art Combs from another order by said judge denying their motion for summary judgment in appeals they had taken from certain orders of said county superintendent. In these appeals in the district court, Bernadine Kirt and others had been permitted to intervene, and they joined the Board of Education of the Unorganized Territory with the above-named defendant in an appeal (No. 38,361) from the same orders, which was also consolidated with the others for hearing.
