1 Appellee, Michael Jerome Hoephner, also known as Michael Jerome Hefner, hereinafter referred to as the defendant, was charged with the offense of Selling an Unregistered Security, in violation of 71 O.S. 1971 Â§ 301 [71-301]. At the end of the States evidence, the defendant moved for a directed verdict of acquittal. The District Court Judge sustained the defendants motion on the ground that the State had not established that the transaction in question involved a security.
